These Terms of Use (“Terms”) govern access to and use of traffhub.io and related pages, forms, referral features and communications operated under the TraffHub brand (the “Website”). By accessing or using the Website, you acknowledge these Terms. If you do not agree, do not use the Website.
1. Website operator
The Website is operated under the TraffHub brand by the operator of traffhub.io (“TraffHub”, “we”, “us” or “our”). TraffHub conducts media-buying and related marketing and technology activities.
2. Informational and B2B nature of the Website
The Website is primarily a corporate, informational and B2B contractor-opportunity website. It may describe TraffHub’s media-buying capabilities, team, operating model, contractor opportunities and referral program.
Nothing on the Website constitutes legal, tax, financial, investment or gambling advice. The Website is not a gambling platform, does not accept wagers or deposits from Website visitors, and does not itself provide a player account or gambling service through the Website.
3. No commercial offer; invitation to discuss
Unless we expressly state otherwise in a document signed by an authorised representative, Website content is an invitation to discuss potential B2B cooperation only and is not an offer capable of acceptance, quotation, promise, guarantee or binding commercial proposal.
Descriptions of budgets, compensation, bonuses, referral rewards, timelines, targets, availability, results, ROI, benefits or other commercial points are indicative and may be changed, withdrawn, corrected or made subject to additional conditions before a contract is signed.
No contract is formed merely because you submit a form, click a button, send a message, receive a response, participate in a call or interview, or satisfy an initial assessment. A contract exists only if and when the relevant parties enter into a separate written agreement or other written instrument expressly intended to be binding.
4. Independent contractor / freelancer model — no employment
All cooperation opportunities presented through the Website are intended to be structured as independent contractor / freelancer engagements on a business-to-business basis, not employment in Hong Kong.
Any reference on the Website to “vacancy”, “job”, “career”, “full-time”, “permanent”, “team”, “probation”, “benefits”, “bonus” or similar employment-style terminology is used for convenience and marketing description only. It does not by itself create an employer-employee relationship, an employment offer, employee status, payroll entitlement or any statutory employment right.
The legal and commercial terms of any cooperation — including scope, fees, working arrangements, tax responsibility, location, confidentiality, IP, termination, compliance and performance terms — are determined exclusively by the separate B2B/independent contractor agreement.
Each contractor is responsible for their own business registration, taxes, social contributions, permits, insurance and other obligations applicable to their status and jurisdiction, unless a written agreement expressly provides otherwise.
5. Contractor-opportunity submissions
You may submit information to be considered for potential B2B cooperation. You are responsible for ensuring that information you provide is accurate and not misleading. You should not submit confidential information belonging to a current or former client/employer, personal data you are not permitted to share, or unlawful material.
We may reject, pause or discontinue discussions at any time before a binding agreement is signed, without any obligation to provide reasons, subject to mandatory law.
6. Referral program
The Website may advertise a referral reward, including figures such as “up to USD 800”. Unless separate written referral rules or confirmation expressly state otherwise, such content is not a binding public offer and does not create an automatic right to payment.
- A referral must be genuine, non-duplicative and submitted in the requested manner.
- The referred person should be reasonably expected to be open to contact from TraffHub.
- Eligibility, milestones, amounts, timing and payment method may depend on written confirmation, successful onboarding, an initial evaluation period, achievement of agreed performance criteria, compliance checks and anti-fraud review.
- TraffHub may refuse or cancel a reward for duplicate, fabricated, unauthorised, abusive or fraudulent referrals or where payment would be unlawful.
- The referrer is responsible for any tax, invoice or reporting obligations applicable to the reward, unless mandatory law requires otherwise.
Where TraffHub confirms a specific referral reward in writing and all confirmed conditions are satisfied, that written confirmation will govern the payment obligation.
7. Eligibility and lawful use
You must be at least 18 years old and legally capable of entering into contracts in your jurisdiction to use the Website for B2B cooperation or referral purposes.
You must not use the Website to violate law, infringe rights, send malware, scrape or disrupt systems, attempt unauthorised access, impersonate another person, submit false information, spam our channels, or misuse forms/referral mechanisms.
8. Media-buying and performance statements
References to strategy, optimisation, scaling, profit, ROI, advertising platforms, GEOs, budgets or past performance are descriptive only. Past or illustrative results do not guarantee future outcomes. Advertising performance depends on many factors outside TraffHub’s control, including platform rules, account status, creative, auction conditions, product, market, compliance and third-party decisions.
9. Third-party platforms and services
The Website may reference or link to Facebook/Meta, Google, TikTok, Telegram, Instagram, LinkedIn, advertising networks, iGaming operators or other third-party services. All trademarks belong to their respective owners. Unless expressly stated, references do not imply endorsement, partnership, agency or affiliation.
Your use of a third-party service is governed by that third party’s terms and policies. TraffHub is not responsible for outages, suspensions, policy changes, data practices or content of third-party services that it does not control.
10. Intellectual property
Unless otherwise stated, the Website, its design, text, graphics, branding, videos, software elements, databases and other content are owned by or licensed to TraffHub and are protected by applicable intellectual property laws, including Hong Kong copyright law.
You may view and use the Website for legitimate personal or B2B evaluation purposes. You may not reproduce, modify, sell, republish, scrape, create derivative works from, reverse engineer or commercially exploit Website content without prior written permission, except where mandatory law permits otherwise.
11. User submissions and feedback
You retain ownership of materials you submit. You grant TraffHub a non-exclusive, worldwide, royalty-free right to host, copy, review, transmit and use your submission only as reasonably necessary to respond, assess B2B cooperation, administer a referral, protect the Website, or fulfil the purpose for which you submitted it.
If you voluntarily provide general feedback or suggestions that do not contain your confidential information, TraffHub may use them to improve its business without an obligation to compensate you, unless separately agreed in writing.
12. Privacy
Personal data is handled in accordance with our Privacy Policy and applicable law. Do not submit personal data relating to another person unless you have a proper basis to do so.
13. No warranties
The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, TraffHub does not warrant that the Website will be uninterrupted, error-free, secure, complete, current or suitable for a particular purpose, or that any B2B opportunity, referral reward or commercial relationship will be available.
14. Limitation of liability
To the maximum extent permitted by applicable law, TraffHub and its directors, officers, contractors and affiliates will not be liable for indirect, incidental, special, punitive or consequential loss; loss of profit, revenue, business, opportunity, goodwill or data; or loss arising from reliance on Website content, third-party services, unauthorised access, downtime, rejected applications or non-binding discussions.
Where liability cannot lawfully be excluded, it is limited to the extent permitted by Hong Kong law. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
15. Indemnity for misuse
To the extent permitted by law, you agree to indemnify TraffHub against third-party claims, reasonable losses and costs arising directly from your unlawful misuse of the Website, infringement of third-party rights, fraudulent referral activity, or submission of information you had no right to provide.
16. Suspension and changes
We may modify, suspend or discontinue any part of the Website, contractor-opportunity listing or referral feature at any time. We may update these Terms by posting a revised version with a new effective date. Changes do not retroactively alter a separate signed contract unless that contract allows it.
17. Governing law and jurisdiction
These Terms and any non-contractual dispute arising out of or in connection with the Website are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules.
Subject to any mandatory rule that cannot be excluded, the courts of Hong Kong have exclusive jurisdiction over disputes arising from these Terms or the Website. A separate B2B agreement may specify a different dispute-resolution mechanism, in which case that agreement governs the relevant B2B relationship.
18. General
If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. Headings are for convenience only. These Terms do not create partnership, agency, employment, fiduciary or joint-venture relationships between you and TraffHub.
